Users are obliged to acquaint themselves with the General Terms and Conditions of use for the Services provided through the Graze.link website. By pressing the button "I accept the General Terms and Conditions", the User automatically acknowledges that he/she is familiar with the General Terms and Conditions and undertakes to comply with them. In case the User intends to use the Services provided through the Graze.link website without making a registration, the User declares that he/she has read and accepts the General Terms and Conditions by the mere use of the Services accessible through Graze.link.

(General Terms and Conditions)

This document sets out the general terms and conditions under which users of the Graze.link website shall be authorised to use the information resources and services provided by Info Asset Ltd, and regulates the relations between Info Asset Ltd, with its registered office and head office at: Sofia, 18 Prof. N. Genchev Str., and each registered or non-registered user of the Services provided through Graze.link.


Art. 1

Services Provided through Graze.link

  1. 1. Services provided through Graze.link are the services to which the Users are granted access through Graze.link: access to certain materials, options for personalisation of content, and other services that are subject to continuous development and addition. The Services may be provided free of charge or for a fee. Particular services and the conditions for their provision are described on the relevant webpages at Graze.link


Paid Services Provided through Graze

  1. The Service allows the Registered User to find and access information resources and materials on the Internet according to criteria defined by the User.
  2. The Registered User is entitled to select the sources from which to read the news and to filter them according to criteria defined by him/her under his/her own responsibility and for his/her personal use. The information so stored by the subscriber is accessible exclusively to him/her.
  3. The Search service allows the User to search and access information resources and materials in the information stored by the subscriber according to user-defined criteria.


  1. Mobile version of the service – a modified version of the service provided by Info Asset Ltd which enables subscribers and users of mobile networks to have easier access to and to use part of the services subject to the present General Terms and Conditions, through the use of access and transmission services provided by the respective mobile operators via mobile networks.
  2. Non-registered User is any User who does not meet the criteria for Registered Users.
  3. Info Asset Ltd is a commercial company with the following UIC BG203731749, with its registered office and head office at: Sofia, 18 Prof. N. Genchev Str. Info Asset is registered under the Value Added Tax Act.
  4. Password is a string of letters, digits and other symbols selected by the Registered User which, in combination with his/her Username, serves to uniquely identify the Registered User and which, together with his/her Username, enables him/her to access his/her User Account.
  5. User is any person using the Services provided through the Graze.link website.
  6. Username is a unique string of letters, digits and other symbols selected by the Registered User which identifies him/her as a Graze.link user.
  7. User Account is a separate section of the Graze.link website containing information on the Registered User, as required by Info Asset Ltd upon registration and stored on the server owned by Info Asset. The Registered User accesses his/her User Account by entering the Username and Password specified by him/her upon registration. Through his/her User Account the Registered User is able to use certain limited-access Services, to configure the Services he/she uses, to suggest integration of new Services, to terminate the use of the Services, to change his/her Password, etc.
  8. Registered User is a Graze User that has created a User Account and has completed the registration process in order to use the Services accessible through the Graze.link website.
  9. Chance Event is a circumstance of unusual nature unforeseen at the time of the contract conclusion which renders the provision of the Services objectively impossible.
  10. Server is a computer device or a system of connected devices, on (one of) which system software is installed to perform tasks related to storing, processing, receiving and/or transmitting information.
  11. Website/Site is a specific place in the global Internet network, accessible through its unified address (URL) under a standardised HTTP or HTTPS protocol or another such protocol, containing files, computer programmes, text, sound, pictures, images or other materials and resources.
  12. Services provided through Graze.link are the services to which the Users are granted access through the Graze.link website: access to certain journalistic materials, options for personalisation of content, and other services that are subject to continuous development and addition. The Services may be provided free of charge or for a fee. Particular services and the conditions of their provision are described on the relevant webpages at the Graze.link Website.

Subject

Art. 2

  1. Users are granted access to the Services provided by Info Asset Ltd, as described below, either free of charge or for a specified payment under the condition of strictly observing and fully complying with the present General Terms and Conditions and any additional requirements stipulated for particular Services and published on the relevant webpages on the Graze.link website (as might be applicable).
  2. The Services provided to the Users by Info asset Ltd that are subject to the present General Terms and Conditions constitute a collection of resources and services pre-announced by Info Asset Ltd on the webpages of the Graze site as provided upon completion of a registration or upon completion of a registration and payment of a certain fee; pre-announced by Info Asset on the webpages of the Graze site as provided upon completion of a registration or without registration and accessible under the relevant regime of use.
  3. Info Asset Ltd is entitled to allow the Registered Users to use the mobile version of the Free Mailbox Service or other Services subject to the present General Terms and Conditions, in the mobile network of which the Registered User is a subscriber or user.
  4. The Services and the access to resources do not include provision of equipment, including computer equipment and Internet connection for transfer of packets between the respective User and the webpage, which are necessary for accessing the system resources. Info Asset Ltd does not bear responsibility if the Subscriber cannot gain access due to circumstances which are not within the control of Info Asset Ltd (hardware, software issues, issues regarding Internet connectivity, etc.), or in case the User owes payments to providers of access and transmission services.

Art. 3. Due to the fact that the Services provided by Info Asset Ltd are various and are constantly supplemented and modified with a view to their improvement and expansion, Info Asset Ltd reserves the right to alter the number of the Services, their characteristics and the regime of Service provision (upon registration, upon registration and payment or without registration) at any time.

Art. 4

  1. The Services provided by Info Asset Ltd may be used after the User completes a preliminary registration by filling in an electronic registration form accessible in real time (on-line) on the webpages of the Graze.link website and by confirming his/her acceptance of the present General Terms and Conditions. The Services for Non-registered Users provided through Graze.link without registration are accessible to any User under the condition of complying with the terms and requirements laid out in the present General Terms and Conditions. Minors who register as Users are required to declare the consent of their parents or legal guardians with the General Terms and Conditions beside their own. In case of registration of a person under 14 years of age a parent or a legal guardian is required to declare his/her consent to the General Terms and Conditions.
  2. The Registered User declares that he/she has read the present General Terms and Conditions, agrees to them and undertakes to observe them through an explicit electronic statement within the meaning of the Electronic Document and Electronic Signature Act, made by marking the checkbox “I agree to the General Terms and Conditions” and by clicking the “Confirm” button. From the moment the electronic statement is preserved on a respective data carrier on the server of the website owned by Info Asset Ltd through a common standard for technical conversion which allows reproduction, it acquires the status of an electronic document within the meaning of the Act mentioned above. Info Asset Ltd may keep log files with the IP address of the Registered User on its server, as well as any other information necessary for identification of the Registered User and for reproduction of the User's electronic statement of acceptance of the General Terms and Conditions, and may use any such information in case legal disputes arise. The Users of Graze.link accessing the Services provided through the Graze.link website without registration confirm their acceptance of the present General Terms and Conditions from the moment they start using the Services provided through Graze.link. The text of these General Terms and Conditions is available on the following web address ....... in a form that allows its storage and reproduction.
  3. The Registered User may without any restriction correct the information entered by him/her in the registration form prior to making the statement under Art. 4.2
  4. In order to be entitled to use the paid Services provided by Info Asset Ltd, the Registered User shall, in addition to the registration, pay the due price or subscription fee using one of the methods of payment indicated on the relevant webpage.
  5. Any Registered User who has acquired the status of "Registered User" after completing the relevant registration form on the Graze.link website gains access to all the Services provided by Info Asset Ltd which only require registration and are accessible at Graze.link, without making a separate registration
  6. When completing the electronic registration form in Graze.link, the Registered User or, in the case of Art. 4.1, a parent or a legal guardian shall provide complete and accurate information as to the Registered User's identity (for natural persons) or legal status (for legal persons) as well as all other information required by Info Asset Ltd in the electronic registration form; any change in the data mentioned above shall be submitted within a 7-day period as of their change. The Registered User declares that the data presented at the moment of registration are true, complete and accurate and in the event of data change he/she shall be obliged to update them in due course. In case the User presents false data, Info Asset Ltd shall be entitled to terminate or to suspend immediately and without prior notification the provision of the Services and to deny the Registered User access to his/her User Account.
  7. In case the Registered User is a minor, the parents exercising parental rights or the legal guardians of the User shall be held responsible for all damages caused by the User to Info Asset Ltd and to third parties in the process of registration and use of the Services subject to the present General Terms and Conditions, and all damages arising from the provision of false information or falsity of the statement under Art. 4.1.
  8. The Services for Non-registered Users provided through the Graze.link website without registration may be used by any User in accordance with the terms and in compliance with the requirements set out in these General Terms and Conditions.

Username and Password

Art. 5

  1. In the course of the registration process the User chooses a Username and Password to access the Services provided through Graze.link. In case the Username is available, the User receives the Username and Password selected by him/her. In case the Username chosen by the User matches one that is already in use, he/she should choose another Username, which is unique and does not match one used by another Registered User.
  2. The Registered User is obliged to take all due care and the measures that are reasonably needed in order to protect his/her Password. The Registered User undertakes not to reveal his/her Password or the answer to the secret question to third parties and to immediately notify Info Asset Ltd in the event of unauthorised access to his/her User Account, as well as if there is probability of such. The Registered User bears full responsibility for the protection of his/her Password and shall be fully liable for all actions performed by him/her or by a third party through the use of the password.

Conclusion of the Contract

Art. 6

  1. The contract between the parties shall take effect at the moment when the consent is expressed by the parties as described under Art. 4.2. The contract is concluded in Bulgarian. By accepting the present General Terms and Conditions, the Registered User agrees the communication with him/her to be carried out also by email or fax.
  2. Immediately after the conclusion of the contract with a Registered User Info Asset Ltd shall confirm the receipt of the statement under Art. 4.2 by sending a message to the newly created mailbox of the User. The message sent by Info Asset Ltd shall include the name, registered address and contact details of Info Asset Ltd, as well as a link to the text of the present General Terms and Conditions.
  3. In case the Registered User wishes to use a particular service provided through the relevant webpage for a specified price, the User should make a specific request to Info Asset Ltd for activation of the service in accordance with the terms of the contract between the parties.
  4. In case the Registered User has made a specific request, all the rights and obligations stipulated in the present General Terms and Conditions shall arise between the parties to the contract. The description of the precise arrangements for provision of any paid service is posted on the relevant webpage on the Graze.link website.
  5. In case the payment for a particular Service or a package of Services is made by sending an SMS or by purchasing a prepaid card, with each SMS sent or each purchase of a prepaid card an individual contract is concluded, which takes effect at the moment when the Registered User enters the received activation code in the "Key" field and then re-enters the activation code and clicks the "Submit” button. If the activation code is not entered within six (6) months of receipt of the code, the individual contract shall be terminated. In cases where the Service is paid for by sending an SMS, the act of sending the SMS implies that the Registered User declares his/her explicit consent to initiate service provision and Par. 5 of the present Article shall not apply.
  6. In case a dispute arises concerning the identity of the person who has expressed his/her will to be bound by the General Terms and Conditions, the person who has made the payment of the price/subscription fee for use of the respective service shall be considered a party to the dispute.

Scope

Art.7.Services subject to separate rules are not included within the scope of the present General Terms and Conditions.

Amendments to the General Terms and Conditions

Art. 8

  1. Due to the fact that the services provided by Info Asset Ltd are various and are constantly supplemented and modified for the purpose of their improvement and expansion and with a view to legislative changes, Info Asset Ltd retains the right to unilaterally amend the General Terms and Conditions.
  2. In case of any amendments to the General Terms and Conditions, Info Asset Ltd shall notify the User of such amendments by publishing them on the Graze.link website and/or by publishing in the User Account of the Registered User an announcement containing the texts of the amendments or a link to a webpage containing the amendments. The User shall be granted a 7-day period to acquaint themselves with the amendments to the General Terms and Conditions.
  3. If within the period under Art. 8.2 the Registered User does not claim to reject the amendments to the General Terms and Conditions, the amendments shall be deemed binding for the Registered User. An Non-registered User shall express his/her disagreement with the amendments to the General Terms and Conditions by terminating the use of the Services accessible to Non-registered Users and provided through Graze.link
  4. In case the Registered User submits a statement to the effect that he/she rejects the amendments, the contract shall be deemed terminated immediately upon the receipt of the rejection notification.

II. SERVICES PROVIDED. CONDITIONS OF ACCESS TO THE SERVICES PROVIDED.

Services Provided through Graze Free of Charge

Art. 9

  1. The Search service allows the User to search and gain access to information resources and materials on the Graze.link website and on the global Internet according to criteria defined by the User.

Pricing and Methods of Payment

Art. 10. The prices and methods of payment of services offered by Info Asset Ltd are explicitly shown on the www.graze.link site.

III. RIGHTS AND OBLIGATIONS OF THE PARTIES

Rights and Obligations of Info Asset Ltd

Art. 11

  1. Info Asset Ltd undertakes to take the due care to enable the User to use the Services subject to the present General Terms and Conditions normally.
  2. Info Asset Ltd has no obligation or objective ability to control the way in which the User uses the provided Services nor to monitor, track and record the information, messages and other materials loaded, deployed, used, distributed or shared with third parties by the User in any way, including the content of the files stored by the User on the server or made available by him/her to third parties in the process of using the Services provided through Graze.link.
  3. Info Asset Ltd retains the right to deactivate or delete the Username and Password for access to the User Account of the Registered User as well as to close the User Account in case the Username and Password remain unused for 180 (one hundred and eighty) days after the last access to the User Account, but not earlier than the expiry date of the last subscription period prepaid by the Registered User or before the exhaustion of the Service package prepaid by the Registered User in the cases where the Registered User uses the paid Services provided for under Art. 10. of the present General Terms and Conditions.

Art. 12

  1. Info Asset Ltd has the right (but not the obligation) to install on the User’s computers cookies – small text files sent by a webpage through an Internet server and placed on the Registered User’s hard drive that enable the system to recover information about the Registered User through his/her identification as well as to track his/her actions. It is possible that third parties may also place cookies on the User's computers in order to advertise goods and services in which the User may be interested during his/her visit to Graze.link or to other websites visited by him/her. Additional information regarding cookies placed by Google Inc. with the AdSense service and the User's right not to provide information to Google Inc. is available here.
  2. Info Asset Ltd is entitled to place on Graze.link links to other webpages and resources as well as to place banners advertising goods and services sold or provided by third parties, including Contextual Advertisements. By accepting the present General Terms and Conditions, the User accepts that links and banners with Contextual Advertisements shall be displayed to him/her during his/her use of the Services.
  3. Info Asset Ltd is entitled to send the Registered User unsolicited commercial communications with information about and advertisements of goods and/or services provided by Info Asset Ltd or by other commercial companies, as well as to address the User with inquiries, questionnaires and the like. By accepting these General Terms and Conditions, the Registered User agrees to receive such unsolicited commercial communications from Info Asset Ltd.
  4. Info Asset Ltd has no obligation to monitor the information stored, transferred or made accessible by the use of the Services subject to the present General Terms and Conditions, nor to seek facts or circumstances indicating illegal activity carried out by the User through the use of the Services or by third parties to whom the User has made available the files stored by him/her on the servers of Info Asset Ltd.

Rights and Obligations of the User

Art. 13. The Registered User is entitled to access and to correct in real time the personal information entered by him/her during the registration process.

Art. 14. The User agrees to comply with the conditions set out by Info Asset Ltd regarding the characteristics of the Services in view of their regime of provision and any other line of conduct adopted by Info Asset Ltd in order to protect or to improve the quality and reliability of the Services.

Art. 15. The User is obliged to provide computer equipment and Internet access required for the use of the Services provided by Info Asset Ltd.


Liability. Limitation of Liability

Art. 16

  1. Info Asset Ltd takes all due care that the information available on the Graze.link website will always be correct and up-to-date, but does not guarantee the authenticity and thoroughness of the content and does not commit to any deadlines for updating the information, unless otherwise explicitly specified on the Graze.link website (as might be applicable). Info Asset Ltd is not obliged to and does not guarantee that the Services provided to the Users will satisfy the Users' requirements or that the provision of Services will be uninterrupted, secure and timely. By accepting the present General Terms and Conditions, the User states his/her acknowledgement that the use of the Service provided shall be entirely at his/her risk and liability. The parties agree that Info Asset Ltd shall not be liable for any damages that might be incurred on the User in the course of the use of the Services.
  2. Info Asset Ltd shall not be liable for any damages caused on the User’s software, hardware or telecommunication devices and equipment, nor for any loss of data arising from any resources or materials searched, loaded or used in any way through the medium of the Services provided.

Art. 17

  1. In view of the fact that Info Asset Ltd does not carry out the transmission of information and does not exercise control on its recipients, nor selects or modifies this information, Info Asset Ltd shall not be liable for the content of the information transmitted through the medium of the Services provided by it or for the User's actions.
  2. In view of the fact that Info Asset Ltd does not carry out the transmission of information and does not exercise control on its recipients, nor selects or modifies the extracted information, Info Asset Ltd shall not be liable for the content of the information obtained through the use of the Search service.
  3. In view of the fact that Info Asset Ltd has no obligation or objective ability to control the webpages and resources to which Graze.link provides access through links and advertisement banners and through the use of the Services, Info Asset Ltd shall not be liable in case the content and materials published on these webpages and resources do not conform with the law. Info Asset Ltd shall not be liable for damages incurred and loss of profit arising as a result of the use of or access to these materials and content or from their inauthenticity.
  4. Info Asset Ltd shall not be liable for the User content stored on Info Asset Ltd's server by a User and for any illegal actions perpetrated through the server as a result of the use of the Services provided through Graze.link, nor for any damages incurred to third parties as a result of the access to and use of information stored on the server of Info Asset Ltd which the User has made available to them.
  5. Info Asset Ltd shall not be liable for the availability, quality and content of the goods and services about which the User is notified through the Graze.link website or through his/her User Account (for Registered Users) by means of any link references, advertisement banners or communications for goods and services offered by third parties and/or by means of link references, advertisement banners or text attached to the email messages in the User's Mailbox. Due to the fact that Info Asset Ltd has no control over the actions of such third parties, Info Asset Ltd shall not be liable for the conformity with the law of the activities of the third parties and for the arising, fulfillment, guaranteeing, amendment and termination of obligations and commitments related to the goods and services provided by the third parties, nor for any damages incurred and loss of profit arising as a result of these obligations and commitments.

Art. 18

  1. Info Asset Ltd shall not be liable for non-provision of the Services due to any circumstances beyond its control – in cases of force majeure events, Chance Events, any problems in the operation of the global Internet network and in the provision of services beyond the control of Info Asset Ltd, as well as in case of unauthorised access or intervention by third parties in the operation of Info Asset Ltd’s information system or servers.
  2. Info Asset Ltd shall not be liable before the User and any third party for any damages incurred and loss of profit arising as a result of suspension, termination, amendment or limitation of the Services, as well as deletion, modification, loss, inauthenticity, inaccuracy or incompleteness of messages, materials and information exchanged, used, recorded or made accessible through the Graze.link website.
  3. The parties agree that Info Asset Ltd shall not be liable for non-provision of the Services or for the worsened quality of the provided Services as a result of tests performed by Info Asset Ltd for examination of the equipment, connections, networks and others, for the purposes of improvement and optimisation of the Services provided. In such cases, Info Asset Ltd shall notify the User in advance of the expected temporary non-provision or worsened quality of the Services by publishing a relevant announcement on the Graze.link website.

Art. 19

  1. The User shall indemnify Info Asset Ltd and any third party for all damages and loss of profit incurred, including for financial penalty payments, attorney fees, and other expenses arising from filed claims by and/or paid compensations to third parties in relation to webpages or other materials that the User has made available to third persons or made accessible through the use of the Services provided by Info Asset Ltd in violation of the Bulgarian legislation, applicable foreign laws, the present General Terms and Conditions, accepted principles of morality and Internet ethics for using the service of Graze.link, as well as in violation of the terms of use of the service or other breach of the User’s obligations under the present General Terms and Conditions.
  2. Apart from the cases stipulated under Art. 19.1, the Registered User shall be obliged to compensate Info Asset Ltd for all damages incurred as a result of the use of the Services by third persons who have been provided by the Registered User with his/her Passwords in violation of the present General Terms and Conditions.

IV. PERSONAL DATA PROTECTION

Personal Data

Art. 20. Info Asset Ltd shall be entitled to collect and use information concerning the User during his/her registration as a Registered User. The information through which the Registered Users can be identified may include personal data, such as: first name, surname, date of birth, sex, as well as any other information voluntarily provided by the User during the registration process under Art. 4. The identifying information may include any other data which the Registered User enters, uses or provides when requesting, receiving or using goods and services through Graze.link (as might be applicable), as well as any information provided by the Registered User when taking part in promotions, lotteries and contests or when filling in inquiries, questionnaires, forms and the like.

Processing of Registered Users' Information

Art. 21.

  1. Info Asset Ltd shall undertake the due care and shall bear responsibility to protect the personal data and any other information for the User which has come to its notion in the process of provision of the Services subject to the present General Terms and Conditions, except in the event of force majeure events, Chance Events or Malicious Actions of third parties.
  2. Info Asset Ltd shall indicate expressly the voluntary or mandatory nature of the data provision and the consequences of refusing to provide such data in the respective registration forms filled in by the Registered User during the registration process. By expressing his/her acceptance of the present General Terms and Conditions, the Registered User agrees his/her information to be processed as stipulated herein.
  3. The application of the restrictions under Art. 21.1. shall be cancelled in the event that the Registered User or third parties under his/her control have performed Malicious Actions within the meaning of the present General Terms and Conditions or have violated any rights or lawful interests of third parties. In the event of any such circumstances Info Asset Ltd shall be entitled to provide the relevant competent authorities with the Registered User’s personal data, in accordance with the applicable law.

Purposes for which the Information may be used

Art. 22

  1. The information about the User collected and used by Info Asset Ltd may be used for the purposes stipulated in the present General Terms and Conditions and for offering new goods and/or services to the User (either paid or free of charge) by Info Asset Ltd or by third parties, as well as for the purposes of promotions, lotteries, questionnaires, inquiries, customisations of the provided services to the User's preferences, for statistical and other purposes. The purposes for which the User's information may be used are not limited to the ones enumerated above and shall not entail any obligations on the part of Info Asset Ltd.
  2. By accepting these General Terms and Conditions, the Registered User agrees his/her personal data to be processed by Info Asset Ltd for the purposes of direct marketing. The User is entitled to revoke the consent so granted by a written message sent from him/her to Info Asset Ltd to its business address or email indicated in the contact details.
  3. Graze.link does not record or preserve the information which is republished from other sites. In case such recording and preservion of information is undertaken, it is to the extent that the technological features of the website require that the site operates, and this period does not normally exceed several hours.

V. VALIDITY OF THE CONTRACT

Termination of the Contract

Art. 23

  1. Besides the cases stipulated in the present General Terms and Conditions, the contract between the parties shall be terminated upon occurrence of one of the following circumstances:
    1. termination of the activity of Info Asset Ltd or termination of the support of Graze.link;
    2. termination upon mutual consent of the parties;
    3. termination in other cases as provided by law.
  2. In case of termination of the contract between the parties, Info Asset Ltd shall be entitled to close the User Account created by the Registered User, and to delete the Password for access to the User's Account of the Subscriber.

VI. OTHER PROVISIONS

Written Statements

Art. 24. The written statements and notifications shall be deemed valid if made in one of the following forms: by sending an email message, by pressing a virtual button on a webpage whose content is filled in or selected by the User, or by ticking a checkbox on the Graze.link website, as well as in other similar manners, as far as the statement is technically recorded in a way allowing its reproduction.

Applicable law

Art. 25. For all matters not settled by the present General Terms and Conditions, the provisions of the Bulgarian legislation in force shall apply. All legal disputes shall be referred for resolution to the competent court in Sofia, Bulgaria.

The present General Terms and Conditions shall take effect as of 20 October 2016.
